Acknowledgments vs. jurats — choose correctly

If the notarial certificate says 'subscribed and sworn before me' or 'sworn to and subscribed,' it is a jurat — the signer must take an oath. If it says 'acknowledged before me' or 'appeared before me and acknowledged,' it is an acknowledgment — no oath required. Choosing the wrong certificate can invalidate the document. When in doubt, ask the receiving party or the attorney who drafted it — the notary cannot tell you which to choose.

What counts as a legal document for notarization?

Any document executed to create, transfer, or terminate a legal right — affidavits, sworn statements, declarations, settlement agreements, releases, indemnification agreements, court filings, custody and visitation agreements, name-change petitions, and notarized letters.

Can a notary give me legal advice?

No. A notary public is not a lawyer (unless separately admitted to the bar) and is prohibited from drafting, interpreting, or advising on legal documents. A notary verifies identity and witnesses signatures — full stop. For drafting or interpretation, retain an attorney.

What's the difference between an acknowledgment and a jurat?

An acknowledgment certifies that the signer appeared and acknowledged signing the document willingly. A jurat certifies that the signer appeared, took an oath or affirmation, and swore the contents are true. Affidavits and sworn declarations require a jurat; most contracts require an acknowledgment.

Do I need to bring witnesses?

Most acknowledgments and jurats do not require additional witnesses. Wills, codicils, and some healthcare directives require two witnesses in addition to the notary. The receiving party (court, agency, title company) should confirm requirements.

Can legal documents be notarized online?

Yes, in states that have adopted remote online notarization (RON). Affidavits, declarations, settlement agreements, and most contracts notarize cleanly online. Court-filed documents may have specific clerk requirements — confirm before scheduling.
